一時的保護指令2条a項は「第三国からの大量流入や切迫した大量流入で出身国に戻ることができない場合」、「即時的かつ一時的保護を提供するための例外的な手続」であるが、EU加盟国の同意が得られず2001年以来、効力発生していなかった。
